1. Skilmálar
1.1 Skilmálar þessir gilda um leigu og sölu á búnaðar frá Kayakar í eigu Herdísar Þ. Jakobsdóttur., kt. 220171-4349, Fellsbraut 15 á Skagaströnd.
Búnaður í þessum skilmálum er hverskonar búnaður, tæki eða tól sem lánuð eða seld eru á hverjum tíma. Mál sem kunna að rísa vegna skilmála þessara má höfða fyrir Héraðsdómi Norðurlands Eystra.
1.2 Með leigu/kaupum á búnaði samþykkir viðskiptamaður öll ákvæði þessara skilmála.
1.3 Leigutaki hefur kynnt sér ástand hins leigða og sættir sig við það að öllu leyti.
1.4 Leigutaki skal sýna aðgæslu við meðferð hins leigða og fylgja reglum og leiðbeiningum um notkun þess og meðferð.
1.5 Leigutaki lýsir því yfir að hann hafi nægilega þekkingu til að nota hið leigða og að hann hafi fengið öryggisbækling til skoðunar sem hann hafi lesið og skilið og að hann muni að öllu leyti fylgja þeim öryggisatriðum sem þar koma fram.
2. Ábyrgð leigutaka
2.1 Leigutaki skal til skila hinu leigða til leigusala í sama ástandi og hann fékk hið leigða afhent.
2.2 Leigutaki ábyrgist hið leigða eins og hann hefði sjálfur nýtt það og ábyrgist að það sé ekki notað (a) í ólögmætum tilgangi, (b) á ógætilegan eða gáleysislegan hátt, (c) undir áhrifum áfengis eða annarra vímuefna.
2.3 Leigutaki skal nota nauðsynlegar hlífar og umbúðir við flutning hins leigða til að forða hinu leigða frá skemmdum.
2.4 Leigutaki ber alla ábyrgð á notkun hins leigða á leigutímanum, þar með talið á öllu tjóni og skemmdum sem kunna að verða á hinu leigða eða af þess völdum.
2.5 Leigutaki skal vera lögráða einstaklingur.
3. Leigutími
3.1 Helgarleiga í leigu telst vera frá 16:00 á föstudegi til 16:00 á sunnudegi. („helgarleiga“).
3.2 Sé hinu leigða ekki skilað á hinum umsamda tíma samkvæmt grein 1.2 skal leigutaki greiða fulla dagleigu fyrir hvern byrjaðan dag umfram skiladag, auk alls kostnaðar sem leigusali kann að verða fyrir vegna þess að hið leigða stendur ekki öðrum viðskiptavinum til boða á réttum tíma.
3.3 Leigusali áskilur sér rétt til þess að fella niður eða færa til leigu vegna veðurs eða óviðráðanlegrar aðstæðna.
4. Trygging fyrir tjóni leigusala
4.1 Leigutaki skal framvísa kreditkorti og er slík framvísun skilyrði fyrir leigu til tryggingar vegna viðgerða og/eða skemmda á hinu leigða á meðan hið leigða er í leigu leigutaka, aukadögum ef hinu leigða er skilað of seint eða af öðrum ástæðum sem veldur leigusala tjóni gagnvart frekari leigu á hinu leigða.
4.3 Ef hið leigða skemmist að því marki að ekki svari kostnaði að mati leigusala að gera við hið leigða er leigusala heimilt að skuldfæra kreditkort leigutaka fyrir endurkaupverði hins leigða án tillits til aldurs eða slits þess.
5. Fyrirvari um ábyrgð leigusala
5.1 Leigusali ber ekki ábyrgð gagnvart leigutaka eða þriðji aðili vegna slysa eða skemmda sem orsakast af notkun, meðferð eða flutningi hins leigða.
5.2 Leigusali ber enga ábyrgð á beinu eða óbeinu tjóni, sem leigutaki eða þriðji aðili kunna að verða fyrir.
6. Annað
6.1 Leigutaka er óheimilt að framselja réttindi sín samkvæmt samningi þessum.
6.2 Komi til málaferla eða innheimtu í tengslum við samning þennan skal slíkt mál rekið fyrir Héraðsdómi Norðurlands Eystra.
Rental terms
1. Terms
1.1 These terms apply to the rental and sale of equipment from Kayakar owned by Herdís Þ. Jakobsdóttir, ID 220171-4349, Fellsbraut 15, Skagaströnd. Equipment in these terms is any type of equipment, device or tool that is loaned or sold at any time. Cases that may arise as a result of these terms and conditions may be brought before the District Court of Norðurlands Eystra.
1.2 By renting/purchasing equipment, the customer accepts all provisions of these terms and conditions.
1.3 The Lessee has reviewed the condition of the leased property and accepts it in full.
1.4 The Lessee shall exercise care in the handling of the leased property and follow the rules and instructions for its use and treatment.
1.5 The Lessee declares that he has sufficient knowledge to use the leased property and that he has received a safety brochure for inspection which he has read and understood and that he will fully comply with the safety issues contained therein.
2. Liability of the lessee
2.1 The Lessee shall return the leased item in the same condition as he received them.
2.2 The Lessee guarantees that the leased property as if he had used it himself and guarantees that it is not used for an illegal purpose, (b) in a negligent manner, (c) under the influence of alcohol or other drugs.
2.3 The Lessee shall use the necessary equipment when transporting to protect the leased property from damage.
2.4 The Lessee is fully responsible for the equipment during the rental period, including all damage that may occur to the leased property or as a result of it.
3. Rental period
3.1 Weekend rental is considered to be from 16:00 on Friday to 16:00 on Sunday (“weekend rental”).
3.2 If the leased equipment is not returned on the agreed time according to Article 1.2, the Lessee shall pay the full daily rent for each commenced day in excess of the delivery date, in addition to any costs that the Owner may incur because the leased equipment is not available to other customers on time.
3.3 The lessor reserves the right to cancel or move the booking due to weather or uncontrollable circumstances.
4. Owners insurance for damages
4.1 The present a credit card as insurance when renting, for repairs and / or damage to the leased equipment while the leased property is in the lessee’s lease, additional days if the leased property is returned late or for other reasons that is causing damage to the Owner ability to further rent out the leased equipment.
4.2 If the leased property is damaged to the extent that it does not meet the cost in the Owner opinion to repair the leased property, the Owner may charge the lessee’s credit card for the repurchase price of the leased property, regardless of its age or wear and tear.
5. Owners Liability
5.1 The Owner is not liable to the Lessee or a third party for accidents or damage caused by the use, treatment or transport of the lessee.
5.2 The Owner is not responsible for direct or indirect damages that the Lessee or a third party may suffer.
6. Other
6.1 The Lessee is not permitted to transfer his rights under this Agreement.
6.2 In the event of litigation or collection in connection with this agreement, such a case shall be brought before the District Court of Norðurlands Eystra.
